Can a business use my photo on their website without asking?

My wife and I were having breakfast at a restaurant that we visit often.  As we were finishing our coffees, I noticed a flash of light coming from behind me.  My wife looked up, and I heard someone giggle “it’s for the website!”  Apparently, one of the staff had taken a picture of the area where we were sitting and was going to post it to the “gallery” section of their website.

Is it just me, or is that uncool?  Shouldn’t they ask my permission before using my photo to promote their business?  Yes, they should.

And would this have happened before the days of privacy-killers like Facebook and MySpace?
